Circle Back Initiative Employer
Terms and Conditions
By applying to join the initiative you agree to pay the agreed fees for the membership level chosen, to The Circle Back Initiative regardless of your application outcome.
Acceptance onto the initiative for employers and also their recruiters is subject to passing any mystery application process conducted by the initiative.
No refund of fees paid will be made by The Circle Back Initiative if the company fails to pass the mystery application process. This includes both the employer initiative and the recruiter initiative.
Once accepted, the company agrees to become a Circle Back Initiative Employer for 2025 and agrees it meets and agrees to maintain, as a minimum, the standards laid out on our website (know as the Employer Commitments) in the initiative locations selected by the employer.
YOUR OBLIGATIONS
During the delivery of our Services, you agree to: (a) comply with the Circle Back Initiative minimum standards outlined in this document that we provide you and any other standards you have provided us that you commit to implement and maintain; (b) use the Circle Back Initiative Badge or wording for recruitment and business promotional purposes only; (c) respond promptly to our communications in relation to the initiative (d) provide, within a reasonable amount of time, accurate, complete and current information or documentation reasonably required in relation to the initiative except for any information that is personal/sensitive, and/or places either party in breach of their Privacy Policy, the Privacy Act 1988 (Cth) or any Commercial-in-Confidence arrangements. (e) if circumstance change and you are no longer able to comply with the Circle Back Initiative minimum standards, you must notify us of this and you agree to stop using the Circle Back Initiative Badge and wording and not to mislead the public into thinking you are a Circle Back Initiative employer; (f) comply with all Laws specific to your business’ industry and locations; (g) if there is an obligation imposed by a Law specific to your industry or location that is similar to one of the Circle Back Initiative minimum standards, but imposes a stronger obligation, you agree to comply with that stronger obligation instead of the relevant standard of ours.
We are not liable if you fail to meet that obligation; and (h) act in good faith. You acknowledge and agree that it is your responsibility to maintain the Circle Back Initiative standards and monitor your compliance. This must be maintained, otherwise we reserve the right to suspend or terminate your use of the Circle Back Initiative Badge or our Services at any time in our sole discretion. You agree to provide us with a non-exclusive licence to display your business’ logo and your business’ name on our website to promote the Circle Back Initiative and to be included in our list of Circle Back Initiative Recruitment Agencies.
Any commitment to the initiative beyond 2025 will be under a separate agreement.The Circle Back Initiative reserves the right to alter or amend the minimum standards, The Circle Back Initiative employer badge, any element of the initiative or cease the initiative at anytime. The Circle Back Initiative may terminate this agreement at any time for any reason, at its sole discretion, including but not limited to if users are in breach of any of the terms and conditions of the initiative.
All material provided by The Circle Back Initiative (Our Content), is our intellectual property and subject to copyright. The trade marks, logos, and service marks displayed on Our Content to denote our brand, as provided to you, and our Circle Back Initiative Badge logo are either our registered or unregistered trade marks (our Marks). Our Marks, whether registered or unregistered, may not be used in connection with any product or service other than those mentioned in this agreement, in any manner that is likely to cause confusion, in any manner that alters the meaning of our Marks, or in any manner that disparages us.
The Circle Back Initiative employer emblem is non-transferable and non-exclusive. IP provided by either party remains the property of the party and can only be used for the purpose of publicising involvement with the Circle Back Initiative. The company agrees not to use The Circle Back Initiative Employer emblem or wording in any manner likely to confuse, mislead, or deceive the public. The Circle Back Initiative provides the emblem "as-is" and makes no warranties, representations or statements, express or implied with respect to The Circle Back Initiative emblem or wording.

Use of the Circle Back Initiative employer emblem and wording trademark is prohibited with the Bronze Membership.

Disclaimer: The Circle Back Initiative and its affiliates will not be responsible for any loss or damages of any kind whatsoever sustained by any party, howsoever caused, as regards to use of the Circle Back Initiative emblem, wording or association with the Circle Back Initiative. This disclaimer shall survive the termination or expiration of this agreement. This Agreement is governed by the law in force in Queensland, Australia. Each party irrevocably submits to the exclusive jurisdiction of courts exercising jurisdiction in Queensland, Australia and courts of appeal from them in respect of any proceedings arising out of or in connection with this Agreement.
